DVR Failure (MCC Tier L Camera)
Edition label: 2026-10
Event: Digital video recorder (DVR) failure for the
camera covering Tier L at MCC New York — the tier where J.
Epstein was housed1
Discovery: August 8, 2019 — two days before Epstein’s death2
Status at time of death: Repair not yet begun; not
recording3
What Happened
The camera directly covering Tier L at MCC was streaming live but not recording to DVR at the time of Epstein’s death.4 The DVR failure was discovered August 8, 2019 — two days before the death — and had not yet been repaired when Epstein died on August 10.5
William P. Barr testified that he did not think the FBI believed the DVR had been tampered with and believed there was a nonmalicious explanation, although he could not recall the technical details.6
What Was Available
William P. Barr personally reviewed the MCC security footage that did exist:7 - Common area camera: recording8 - Partial view of the stairway to Tier L (from the same common-area camera): recording9 - Camera directly down L block: live stream only, not recording10
According to the July 29, 2025 CBS News report quoted in the Barr transcript, two additional cameras were recording, but neither video had been publicly released as of that report:11 - Elevator bank camera12 - Guard desk camera13
No official reason for non-release appears in the record; CBS reported that federal officials had dismissed the recordings as unhelpful.14
Significance
The DVR failure is one of the simultaneous failures William P. Barr describes as “all these screwups happening at the same time.”15 In isolation, Barr testified that he did not think the FBI believed the DVR had been tampered with, and that it saw a nonmalicious explanation.16
Disputed Footage
The footage that was publicly released has been analyzed by CBS News and by outside video forensic experts consulted by CBS, who reported:17 - An “orange shape” on the stairs18 - A possible third unidentified individual19
A CBS report noted that video forensic experts it consulted disputed the OIG’s interpretation of the orange shape (a corrections officer carrying linen or inmate clothing), and said the OIG report did not address a third unidentified individual seen on the video;20 Barr disagreed with the orange-shape interpretation and said the footage raised no unidentified-person concern for him.21
